Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TenderFinderat tenderfinder.co.za (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Service is

TenderFinderaggregates South African public procurement information (including government tenders, RFQs and related notices) from the National Treasury eTenders portal's publicly available OCDS data, and presents it in a searchable portal with email alerts, saved searches and closing-date reminders. Pro accounts can also generate an AI analysis of an individual tender, subject to clause 6A. We are an independent service and are not affiliated with, or endorsed by, the National Treasury or any organ of state.

2. Accounts

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for safeguarding your password and for all activity under your account.
  • You must be at least 18 years old and able to enter into a binding agreement to use the Service.
  • One account is for one user unless your plan expressly includes multiple users.

3. Subscriptions and billing

  • Paid plans are billed in South African Rand (ZAR) through PayFast, our payment processor, on a monthly or annual cycle depending on the option you choose.
  • Subscriptions renew automatically at the end of each billing period unless cancelled.
  • You may cancel at any time. Cancellation takes effect at the end of your current billing period; you keep access until then. We do not offer pro-rata refunds for unused time unless required by law.
  • We may change plan prices or features with reasonable advance notice. Changes apply from your next billing period.

4. Free plan

The Free plan is provided as-is with limits that may include a capped number of tender listings and full tender views per day, a single province and category selection, delayed tender data, a daily tender email delayed by 48 hours instead of custom alerts, and advertising. We may adjust Free plan limits from time to time.

5. Acceptable use

  • Do not scrape, bulk-download, resell or redistribute the Service's compiled data or content without our written permission.
  • Do not share account credentials beyond the number of users your plan allows.
  • Do not use the Service to send spam, infringe any law, or interfere with the operation or security of the Service.
  • We may suspend or terminate accounts that breach these Terms.

6. Tender data and accuracy

We republish public procurement data and strive to keep it current and accurate, but we do not control the source data and cannot guarantee that it is complete, correct or up to date. Tender details, documents and closing dates can change on the official portal at any time. Always verify tender details against the official tender documents on tenderfinder.co.za, and with the buyer's contact person named in those documents, before preparing or submitting a bid. TenderFinder is a discovery tool; it is not part of any official tender process, and using it does not submit, register or qualify any bid.

6A. AI analysis

Pro accounts can generate an AI analysis of a tender. The analysis is machine generated from the published tender notice and the tender documents our system is able to read. It may be incomplete or wrong, some tender documents cannot be read by our system and are listed in each analysis, and the official tender documents always prevail.

The analysis is not legal, procurement, financial or professional advice. You remain responsible for checking every requirement, form and deadline against the official tender documents, and for the content, pricing and submission of your own bid. Daily and monthly analysis limits apply to your plan and may be adjusted with reasonable notice. We are not liable for a bid that is disqualified, unsuccessful or not submitted.

7. Intellectual property

The Service's software, design, branding and original content belong to TenderFinder. Underlying public procurement data remains public information. You receive a limited, non-exclusive, non-transferable licence to use the Service for your own business purposes while your account is in good standing.

8. Limitation of liability

To the maximum extent permitted by law, TenderFinder will not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, revenue, contracts or opportunities (including a missed or unsuccessful tender) arising from your use of, or inability to use, the Service, or from your reliance on any AI generated analysis. Our total aggregate liability for any claim is limited to the amount you paid us for the Service in the three months before the event giving rise to the claim.

9. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by law. Sections that by their nature should survive termination (including limitations of liability) survive.

10. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will give reasonable notice (for example by email or an in-app notice) before it takes effect. Continued use of the Service after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them. Nothing in these Terms limits any right you have under the Consumer Protection Act or other applicable legislation that cannot be excluded by agreement.
